4. Legal Basis for Processing
We process personal data under the following legal bases: performance of a contract (Art. 6(1)(b) GDPR), legitimate interest in service improvement (Art. 6(1)(f) GDPR), and explicit consent where required (Art. 6(1)(a) GDPR).
5. Data Retention
Personal data is retained for the duration of the service engagement plus five (5) years for legal and tax compliance. Anonymized data may be retained indefinitely for statistical analysis.
6. Data Sharing
We do not sell or rent personal data. Data may be shared with: payment processors (Stripe), hosting providers, and analytics platforms solely for service delivery. All third-party processors are bound by Data Processing Agreements (DPAs) compliant with Art. 28 GDPR.
7. International Transfers
Where data is transferred outside the EEA, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission to ensure adequate protection.

Terms of Service

These Terms of Service ("Terms") govern all engagements between MarketCraftDigital, located at VIA DELL'AZZURRO 9, 50038 SCARPERIA E SAN PIERO, Italy, and the client ("you" or "your").
1. Scope of Services
MarketCraftDigital provides digital marketing, web design, SEO optimization, paid advertising management, and related digital services as described in individual service agreements and proposals.
2. Service Agreement
Each engagement is governed by a specific service proposal or statement of work (SOW) mutually agreed upon. These Terms apply as the baseline framework for all SOWs unless explicitly superseded.
3. Payment Terms
Invoices are payable within 14 days of issuance unless otherwise specified in the SOW. Late payments incur a 2% monthly interest rate. All prices are in EUR and exclude applicable taxes unless stated otherwise.
4. Intellectual Property
Upon full payment, all deliverables including designs, code, content, and creative assets are transferred to the client. MarketCraftDigital retains the right to display completed work in portfolio and case studies unless otherwise agreed in writing.
5. Client Responsibilities
The client shall provide timely feedback, necessary access credentials, brand assets, and content within agreed-upon timelines. Delays in client-provided materials may result in adjusted project timelines.
6. Limitation of Liability
MarketCraftDigital's total liability shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
7. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of three (3) years.
8. Termination
Either party may terminate with 30 days written notice. In case of termination, the client is invoiced for all work completed up to the termination date. Non-refundable third-party costs incurred on the client's behalf remain payable.
Refund & Reimbursement Policy

MarketCraftDigital, located at VIA DELL'AZZURRO 9, 50038 SCARPERIA E SAN PIERO, Italy, maintains the following refund and reimbursement policy for all digital marketing and web design services.
1. Eligibility for Refund
Refund requests are evaluated based on the project milestone status at the time of cancellation. Services that have been fully delivered, reviewed, and accepted by the client are non-refundable.
2. Milestone-Based Refunds
For projects structured in phases, refunds are calculated proportionally based on completed and paid milestones. Unstarted phases are eligible for full refund minus any non-recoverable third-party costs already incurred.
3. Request Process
Refund requests must be submitted in writing to [email protected] within 14 days of the relevant invoice date. Requests include the invoice number, reason for the refund, and supporting documentation.
4. Processing Timeline
Approved refunds are processed within 14 business days via the original payment method. Stripe payment link transactions are refunded directly through the Stripe dashboard.
5. Non-Refundable Items
The following are non-refundable: domain registration fees, third-party software licenses purchased on behalf of the client, completed and delivered design assets, and ad spend managed through client ad accounts.
6. Dispute Resolution
In the event of a refund dispute, both parties agree to attempt resolution through good-faith negotiation within 30 days before pursuing alternative dispute resolution. Governing law is that of the Italian Republic.
